UK to convert EU trademarks and designs for free- post Brexit.

In a significant move by the UK Government, it will convert all the existing EU trademarks and designs for free after Brexit. Instead of the EU level rights, 1.5 million new UK trademarks and registered designs will be granted automatically and for free. Even unregistered designs will also be protected in UK. In this way EU IP rights will be cloned onto the UK register at no cost to the right owners.

It will be under the sole control of UK Governnemnt not the European commission. The effort is aimed towards bringing EU rights at par with UK rights at the end of Brexit transition period which concludes on 31st December’ 2020. The Government is confident that the creative industry will get a major boost due to the above steps. However, there is no clarity upon whether UK Attorneys will be able to represent IP owners at the EU IP office after the UK’s departure from the EU on 29th March’2019.

Accordingly, various mutual benefits are being finalized between UK and EU towards IP protection.
